PURPOSE: These Terms & Conditions are here to clearly explain, outline, and lay out the rules, terms, and conditions of using, viewing, and/or browsing the Site and/or purchasing or downloading any course, program, service, or product offered on or by us or the Site.

By using the Site, you agree to the Terms & Conditions as stated herein, regardless of whether or not you have read these Terms & Conditions.

These Terms & Conditions contain a Dispute Resolution Clause and require you to attempt to resolve any claim with us before pursuing formal legal action. By agreeing to these Terms & Conditions, you agree to the Dispute Resolution process outlined in Paragraph No. 19.

By proceeding on the Site, you hereby agree to the following:

1. Accessing and Acknowledging Our Legal Documents

The legal documents that govern your use of our Site, Courses, Services, and/or Products (including these Terms & Conditions, our Privacy Policy, and our Disclaimer) are available on the Site at https://theglobalacademicstudio.com/. You are encouraged to review these documents before signing up for any Course, Service, or Product.

If, for any reason, the Site is unavailable or you are unable to access any of the legal documents on the Site, you may request copies by emailing robby@theglobalacademicstudio.com. We will provide the requested documents to you promptly.

You should only sign up for our Courses, Services, and/or Products after you have had the opportunity to access and review the applicable legal documents. By signing any agreement, completing any purchase, or otherwise engaging our Courses, Services, and/or Products, your signature or action serves as confirmation that you have accessed, read, and accepted these Terms & Conditions, our Privacy Policy, and our Disclaimer. If you do not agree with any of these documents, please do not proceed with your purchase or engagement.

Definitions

“I,” “Me,” or “My” means Tamas Robert Cserni, operating as The Global Academic Studio and owner of https://theglobalacademicstudio.com/.

“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Tamas Robert Cserni, The Global Academic Studio, and/or https://theglobalacademicstudio.com/, and any and all written or downloadable material purchased, viewed, or otherwise offered by The Global Academic Studio and/or on https://theglobalacademicstudio.com/, including, but not limited to, graphics, newsletters, designs, documents, information, templates, and materials.

“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information includes, among other things, your name, address, email address, telephone number, etc.

“Site, Courses, Services, and/or Products” means https://theglobalacademicstudio.com/, Content (as defined herein), email list/newsletters, social media posts, courses, coaching services, guides, forms, worksheets, workbooks, webinars, website materials, workshops, and coaching programs available on the Site.

“Site” means https://theglobalacademicstudio.com/ and any and all of its associated pages, tabs, landing pages, forms, or sub-pages.

“You” or “Your” means the user, customer, or viewer of the Site.

2. Consent

By using the Site and/or making any Purchase, you implicitly and voluntarily agree to act in accordance with, and abide by, these Terms & Conditions, Privacy Policy, and Disclaimer, as managed and enforced by Tamas Robert Cserni, operating as The Global Academic Studio.

By using the Site and/or making any Purchase, you represent and warrant that you are at least 18 years old. Any use of, or access to, the Site and its Content by anyone under the age of 18 is unauthorized and in direct violation of these Terms & Conditions and our Privacy Policy.

By using the Site and/or making any Purchase, you hereby agree and consent not to:

Send or transmit obscene, offensive, libelous, defamatory, pornographic, or abusive content, as well as content that infringes our intellectual property rights or those of another person, website, or company. Use the Site in any way or for any purpose which violates any applicable law or regulation in the jurisdiction in which you use the Site. Post or transmit any “spam” or unwanted, unsolicited content. Copy, download, share, post, or transmit Tamas Robert Cserni’s intellectual property in any way that infringes on his intellectual property rights.

4. DISCLAIMER

By using the Site, you understand that I am an academic coach and educator. I hold a PhD in Sociology and have extensive experience in higher education, academic coaching, and curriculum design. I am not a licensed therapist, counselor, medical professional, attorney, or financial advisor. You should consult a qualified professional in those areas where you live or work to discuss issues or questions pertaining to your particular mental health, medical, legal, or financial situation. My Content is for informational and educational purposes only, and is based on my professional experience and expertise. My Content is not meant as a substitute for professional advice from a licensed or accredited practitioner. For a full list of professional services that coaching is not a substitute for, and your responsibilities when engaging with our services, please refer to Section 16 of these Terms & Conditions.

5. Your Consent to These Terms & Conditions

By using this Site, or Purchasing or Downloading from my Site, Courses, Services, and/or Products, you implicitly and voluntarily agree to these Terms & Conditions as stated herein.

6. Changes to These Terms & Conditions

I reserve the right to change, amend, or otherwise alter these Terms & Conditions at any time without notice to you. When changes are made to these Terms & Conditions, I will update the “Updated on” date at the bottom of this page. If you do not agree with these Terms & Conditions, please do NOT use my Site, read or implement its Content, or Purchase or Download anything from me.

7. Links to Third-Party or External Websites

The Site may contain or include website URL links to third-party or external websites. Typically, these URL links are provided so that you may directly access a site that contains relevant information. Please note I am not liable for any of the information contained on or within the third-party or external websites. I am not responsible for the way they handle your personal information, whether they have a privacy policy, or any information you provide to them by visiting their website. You are responsible for reading and agreeing to, or expressing disagreement with, the external website’s privacy policy or terms and conditions.

The Site and its Content are protected by UK copyright and intellectual property laws. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.

9. My Limited License to You

If you view, access, or Purchase the Site, Courses, Services, and/or Products, you are considered my Limited Licensee (“Licensee”). As a Licensee, you agree and understand that the Site, Courses, Services, and/or Products have been written, created, drafted, invented, and developed after a significant investment of time, money, education, hard work, and expertise. The Site, Courses, Services, and/or Products are extremely valuable to me, both professionally and personally, and I take the protection of my Site, Courses, Services, and/or Products very seriously.

You may not use the Site, Courses, Services, and/or Products in any manner that is unauthorized, improper, against these Terms & Conditions or my Privacy Policy, or which violates UK intellectual property laws, unless authorized by me in writing beforehand.

10. Your License to Me

By commenting on the Site, or submitting documents to Tamas Robert Cserni or The Global Academic Studio via contact form, email, or social media, you represent that you are the lawful owner of said documents, statements, and/or the information they contain. You grant me a license to use your comments or submissions in any way I see fit, as it relates to my business purposes.

11. Purchase & Access Terms

During the course of your use, Purchase, and/or Download from the Site, Courses, Services, and/or Products, you agree and understand that you cannot distribute, copy, forward, and/or share information prohibited by these Terms & Conditions. You also agree and understand that you are to take all necessary steps to make sure that you do not inadvertently share or distribute said materials, including, but not limited to, protecting your password (if any) to the Site to access your Purchase or Download. Any violations of these Terms & Conditions will be legally pursued to the fullest extent permitted by law.

12. Sharing the Site & Its Content

You must request and receive written permission by email at robby@theglobalacademicstudio.com before sharing my Site and its Content for commercial purposes. You may share the Site for personal purposes, but I ask that you link directly to the Site. You are required to give me and the Site credit by linking to the Site and its Content if you share it on social media or your own website. Since the Site and its Content are not yours, you may not in any way imply or represent that the Site or its Content are yours or that you in any way created, caused, or contributed to the Site or its Content. You may not make any claims that you are in any way associated with Tamas Robert Cserni or The Global Academic Studio.

13. No Claims Made Regarding Results

Any and all current or past client testimonials, statements, or examples used by me are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each client and their circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of mine.

14. DISCLAIMER: No Warranties, Guarantees, or Representations Are Being Made

I do not offer any warranties, of any variety, regarding the Site, Courses, Services, and/or Products, and/or your Purchase or Download, in any way. The Site, Courses, Services, and/or Products, and/or your Purchases or Downloads are offered “AS IS” and without warranties of any kind, neither express nor implied, to the extent permitted by law.

15. Statutory Consumer Rights

Nothing in these Terms & Conditions excludes, restricts, or limits any rights you may have as a consumer under applicable UK law, including but not limited to the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

‍Any provision of these Terms & Conditions shall be interpreted subject to applicable consumer protection legislation, and where any term conflicts with statutory rights, those statutory rights shall prevail.

16. Acknowledgment of Service Nature and Your Responsibilities

By using the Site or Purchasing, Downloading, or using any of my Courses, Services, and Products, you acknowledge that the services provided by The Global Academic Studio are educational and developmental in nature. They are not and shall not be considered a substitute for any of the following professional services: therapy, counselling, psychotherapy, or any form of mental health treatment; medical or healthcare advice; legal advice; financial, accounting, or tax advice; immigration advice; or career placement, recruitment, or employment services. I am not a licensed or accredited practitioner in any of these fields. If you require advice or support in any of these areas, it is your responsibility to consult a qualified professional.

Coaching involves reflective conversations that may, by their nature, touch on personal experiences, emotions, and challenges. You acknowledge that engaging in developmental and reflective work may at times be emotionally challenging, and that this is a normal part of the coaching process rather than an indication of harm. If at any point you feel that you need mental health support beyond the scope of coaching, it is your responsibility to seek appropriate professional help. I will, where I consider it appropriate, recommend that you seek such support, but I am not responsible for monitoring or managing your mental health.

While our conversations may touch on topics related to the professional fields listed above, any views, observations, or suggestions I offer are based on my experience as an academic coach and educator, not as a qualified professional in those fields. You should not rely on anything discussed in coaching as a substitute for professional advice, and any decisions you make based on our conversations are made at your own judgment and discretion.

Outcomes depend on your own engagement, effort, circumstances, and decisions. I do not guarantee any specific results, including but not limited to academic achievement, career advancement, employment outcomes, or personal development milestones.

If at any point during our engagement I have reasonable grounds to believe that there is a risk of serious harm to you or to others, I reserve the right to contact the appropriate authorities or emergency services. Any such action will be taken in good faith and in accordance with my professional and ethical obligations. You acknowledge that I shall not be liable for any consequences arising from a good faith report of a safeguarding concern, and that such a report does not constitute a breach of confidentiality or of these Terms & Conditions.

Nothing in this section excludes or limits any rights you may have under applicable consumer protection law or any liability for death or personal injury caused by negligence.

17. Errors & Omissions

Every effort is made to provide up-to-date accurate information both on the Site and through my services. However, due to the complexity of the issues I cover, I and The Global Academic Studio do not and cannot warrant, represent, or guarantee that such information is free from errors, accurate, or up-to-date at all times. You should do your due diligence, research, or consult with a professional to ensure that all information you receive, act upon, or rely on from this Site and/or from my services is accurate and up-to-date.

18. My Refund Policy

Where you are purchasing as a consumer within the United Kingdom or European Economic Area, you may have a statutory right to cancel certain purchases within 14 calendar days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. For clarity, all references to days in this section mean calendar days, including weekends and public holidays. Nothing in this section excludes, restricts, or overrides your statutory rights.

Where services begin during the 14-day cancellation period at your express request, you acknowledge that you may lose your right to cancel once the service has been fully performed. If you cancel within the 14-day period after services have commenced, you will be required to pay for any services already delivered up to the point of cancellation.

Subject to the statutory rights described above, refunds will not be issued for coaching services already delivered or digital products already accessed, except where required by applicable consumer law. After the expiry of the statutory cooling off period, the refund position for any ongoing Service engagement is governed by the terms of your specific Service agreement.

I aim to provide high-quality services and products and want you to be satisfied with your experience. I will do everything within my ability and within reason to ensure your satisfaction. I may, at my sole discretion, consider requests for refunds or other accommodations on a case-by-case basis. Any such accommodation is a goodwill gesture and does not create a precedent, obligation, or entitlement for any future request by you or any other client.

19. Dispute Resolution

If you have any complaint or should any issue arise in the use of the Site or The Global Academic Studio’s Courses, Services, and/or Products, please contact me directly first by emailing robby@theglobalacademicstudio.com. I am committed to resolving disputes fairly and promptly.

If I am unable to resolve your dispute informally, we agree to attempt mediation before pursuing formal legal proceedings. Mediation may be facilitated through a mutually agreed upon mediator or through a recognized UK mediation service such as the Centre for Effective Dispute Resolution (CEDR).

Should mediation fail to resolve the dispute, either party may pursue their legal remedies through the courts of England and Wales, which shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms & Conditions.

The only remedy available to you in any such proceedings is a refund of any payment made to Tamas Robert Cserni, operating as The Global Academic Studio, for the applicable Product or Service.

20. Consent to Governing Law

These Terms & Conditions, and any dispute arising out of them, shall be governed by the laws of England and Wales.

21. Consent to Jurisdiction

You hereby irrevocably consent to the exclusive jurisdiction and venue of the courts of England and Wales in connection with any matter arising out of these Terms & Conditions, Privacy Policy, Disclaimer, or as a result of your use, Download, or Purchase from the Site, Courses, Services, and/or Products.

22. Consent to Service

You hereby irrevocably agree that process may be served on you in any manner authorized by the laws of England and Wales for such persons, and you waive any objection which you might otherwise have to service of process under the laws of England and Wales.

23. Payment & Purchases

When you Purchase or Download one of our Courses, Services, and Products from us or the Site, you may pay by credit card or other accepted payment methods. By doing so, you give Tamas Robert Cserni or The Global Academic Studio permission to charge your chosen payment method for the agreed amount. You will receive an electronic receipt following your Purchase, which you should retain for your records.

If you elect an installment or pay-over-time option at checkout, you agree that Tamas Robert Cserni or The Global Academic Studio has permission to automatically charge, without checking with you before each installment transaction is charged, the amount due on the date or dates agreed upon at checkout.

If your payment method fails or is otherwise declined, you will be removed from, or canceled from having access to, our Courses, Services, and Products. Please note, in the event your payment method is declined at any time, you are still responsible for the full cost of your Purchase.

If any payment due under these Terms & Conditions remains unpaid for more than 14 days after the due date, I reserve the right to suspend access to and delivery of any Courses, Services, and/or Products until the outstanding balance, including any accrued interest, is paid in full. I will notify you in writing before any suspension takes effect. Suspension of services does not relieve you of your obligation to pay the full amount owed. Upon receipt of full payment, access and delivery will be reinstated within a reasonable timeframe. For the avoidance of doubt, any Sessions, access periods, or delivery timelines that lapse during a period of suspension due to non-payment shall not be extended or credited unless otherwise agreed in writing.

We do not accept any chargeback threats, real or threatened. If any chargebacks are placed on a Purchase or Download of our Courses, Services, and Products, we reserve the right to pursue recovery of funds owed through appropriate legal channels. Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of those payment processing companies.

You hereby release us from any and all damages related to your payment or use of our payment processing companies and further agree not to assert any claims against us for any damages which arise from your Purchase or use of our Site and its Content.

If any payment due under these Terms & Conditions is not received by the due date, I reserve the right to charge interest on the overdue amount at a rate of 4% per annum above the Bank of England base rate, calculated from the date the payment was due until the date payment is received in full. Interest shall accrue on a daily basis. This right to charge interest is without prejudice to any other rights or remedies available to me under these Terms & Conditions or at law.

24. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits my liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law, including your statutory rights under the Consumer Rights Act 2015.

Subject to the paragraph above, my total liability to you under or in connection with these Terms & Conditions, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you for the specific Course, Service, or Product giving rise to the claim.

Subject to the first paragraph of this section, I shall not be liable for any indirect, consequential, or special losses, including but not limited to: lost earnings or income; missed career or academic opportunities; loss of anticipated savings; loss of data; damage to reputation; or any other loss arising from your reliance on the Site, Courses, Services, and/or Products that was not reasonably foreseeable at the time of your Purchase.

You are responsible for ensuring that the Site, Courses, Services, and/or Products are suitable for your purposes. I do not warrant that the Site, Courses, Services, and/or Products will meet your specific requirements or expectations, except as expressly stated in these Terms & Conditions or in a separate written agreement.

25. Your Liability for Misuse

You agree to hold harmless and indemnify Tamas Robert Cserni and The Global Academic Studio from any losses, damages, and reasonable costs (including legal fees) arising directly from: (a) your breach of these Terms & Conditions or the Privacy Policy; (b) your misuse of the Site, Courses, Services, and/or Products in a manner not authorized by these Terms & Conditions; or (c) any claim by a third party resulting from materials, information, or content you provided to us that infringes the rights of that third party.

This indemnity does not apply to any loss caused by my own negligence, breach, or fault, and nothing in this section excludes or limits any rights you may have under applicable consumer protection law.

26. Termination

26.1 Termination by Me for Breach

I may terminate your access to and use of the Site, Courses, Services, and/or Products with immediate effect and without liability to you if you abuse, violate, or breach any of these Terms & Conditions, Privacy Policy, Disclaimer, or any other terms to which you have agreed.

26.2 Termination by Me for Other Reasons

I may terminate or discontinue any ongoing Service engagement at any time by providing you with 14 days’ written notice. This includes, but is not limited to, situations where the client relationship has become unworkable, where continuing would compromise my professional judgment, or where a client’s conduct is disruptive, unreasonable, or potentially unlawful. In such cases, refunds will be calculated on a pro rata basis for any Services not yet delivered at the date of termination.

26.3 Termination by You

You may end any ongoing Service engagement at any time by providing written notice to me at robby@theglobalacademicstudio.com. Termination of the Service engagement does not automatically release you from any outstanding financial obligations under these Terms & Conditions or any related agreement. Your financial position upon termination, including any entitlement to a refund for Services not yet delivered, will be determined in accordance with Section 18 (My Refund Policy), the terms of your specific Service agreement, and any applicable statutory rights.

26.4 Consequences of Termination

Upon termination by either party: (a) your access to any Courses, Services, and/or Products will cease; (b) any outstanding fees remain due and payable; (c) any provisions of these Terms & Conditions that are intended to survive termination (including, but not limited to, Intellectual Property, Limitation of Liability, and Governing Law) shall continue in full force and effect.

27. Entire Agreement

These Terms & Conditions, Privacy Policy, and Disclaimer constitute the entire agreement between you and me with respect to the Site, Courses, Services, and/or Products, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and me with respect to the Site, Courses, Services, and/or Products.

These Terms & Conditions, together with the Privacy Policy and Disclaimer, represent the sole terms under which I offer the Site, Courses, Services, and/or Products. If you or any organization acting on your behalf proposes alternative or additional terms, those terms shall have no effect unless expressly accepted by me in writing. In the event of any conflict between these Terms & Conditions and any other terms proposed by you or a third party, these Terms & Conditions shall prevail.

28. Severability

The provisions of these Terms & Conditions are severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision herein. If any paragraph, section, subsection, sentence, or clause of these Terms & Conditions is rendered illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on these Terms & Conditions as a whole or on any other paragraph, section, subsection, sentence, or clause herein.

31. Force Majeure

I shall not be liable for any failure or delay in performing my obligations under these Terms & Conditions where such failure or delay results from circumstances beyond my reasonable control. Such circumstances include, but are not limited to: illness or incapacity; pandemic, epidemic, or public health emergency; natural disaster, severe weather, or environmental events; technology failure, internet outage, or platform disruption; power failure or utility disruption; transportation disruption, including but not limited to flight cancellation, train delay or cancellation, travel ban, border closure, or vehicle breakdown; government action, regulation, or restriction; civil unrest, war, or terrorism; and any other event that could not have been reasonably foreseen or prevented.

In the event of a force majeure situation, I will notify you as soon as reasonably practicable and will make reasonable efforts to resume or reschedule the affected Services. Where a force majeure event prevents me from delivering a Service for which you have already paid, I will offer to reschedule the Service to a mutually agreeable time. If the force majeure event continues for a period exceeding 60 calendar days, either party may terminate the affected Service engagement by providing written notice, and any refund for Services not yet delivered will be calculated on a pro rata basis.

Nothing in this section limits your statutory rights or excludes liability for death or personal injury caused by negligence.
